Conditions générales d'utilisation

1. General information

In these conditions “the company” or “the Seller” means P&P Shuttle or any subsidiary thereof. “The user” refers to the person booking our services.

We reserve the right to amend, change or delete these terms and conditions at any time by updating this page, without prior notice. You should check this website from time to time to review the current terms and conditions.

2. Formation of the contract

Requesting an estimate via the P&P Shuttle website does not constitute a booking. At this stage, you are free to change, correct and amend any data on the form.

Once we have supplied an estimate and received confirmation of your booking in writing, you will have submitted a binding booking request. We will then send a confirmation by email, in which your booking is displayed. Please check the details carefully to ensure that they are correct.

3. Content of the contract

The prices for your journey apply to a start address and one-way ride, unless otherwise requested at the time of booking (for example, for a tour of the city). Additional stopovers are subject to an additional fee according to the current price structure.

The rates for hourly or daily bookings are based on the requested time period. The price listed on the confirmation includes the amount of luggage stated at the time of booking. Fees will be charged for the transportation of excess baggage or animals. Excess baggage must be registered and animals transported in a closed transport box.

No hidden taxes, fees or extra charges will be payable on the completion of the job, unless they fall under the exceptions outlined in our terms and conditions, or they have been discussed with you at the time of booking.

If you are travelling with children, please let us know at the time of booking to ensure that the correct child restraint devices are supplied.

Under French law, children up to the age of 10 must travel in an approved child seat or restraint, adapted to their age and size. Children under the age of 10 are not allowed to travel in the front seats of vehicles unless there is no rear seat in the vehicle, or the rear seat is already occupied with children under 10, or there are no seat belts.

The French Highway Code does not specify a minimum height that a child has to be in order to not use a child seat/restraint, because of this we would advise that you apply the minimum height as set by the European Directive, which is 150cm.

Based on the information you give us, we will always do our best to ensure that you have a vehicle large enough to accommodate everyone in your party and their luggage. However, the chauffeur has the right to refuse passengers if there is a concern about space or safety conditions.

Exceptional circumstances beyond our control, such as air traffic controllers’ strikes, bad weather conditions or a road accident can affect our transport services and may lead to longer waiting times or cancellations at short notice. The user must accept that we cannot warrant against such circumstances.

Spontaneous changes of the tour by the customer are possible in general and may lead to a change in the price of the tour (see section 4 below). If the customer is not the passenger, the right of spontaneous changes of the tour switches to the passenger.

In the case of hourly bookings, the tour has to end within the business district of the pickup address. The minimum booking duration is two hours.

We reserve the right to substitute any vehicle or chauffeur/driver.

4. Compensation and payment

The price specified in your booking confirmation is a binding fixed price, including all taxes and tips.

The guaranteed reservation price we give you at the time of booking is calculated from the chosen vehicle class, the distance or the amount of hours, the lead time, the pick-up time, and the pick-up location.

In the case of spontaneous changes to the distance to be travelled or the amount of hours you need the vehicle and driver, the price of the actual total distance or hours will be calculated and charged after the completion of the ride in accordance with the current price structure. Once a half hour has started, it can be invoiced, i.e. starting with the first additional minute, time will be rounded up to a half hour.

If the route is shorter than the originally booked distance or number of hours, the original amount will be charged.

In the case of transfers, there are no surcharges for waiting times of up to 15 minutes. Additional waiting times of over 15 minutes caused by passenger behaviour will be charged per minute with a part of the hourly booking prices of the particular business district and vehicle category, plus applicable VAT. This does not apply to flight or train delays, which we understand are beyond your control. In general, the waiting time starts with the provided pick-up time. If your ride starts at the airport, please allow sufficient time after landing to collect your checked luggage and to cross the airport. We view waiting time at baggage claims as a self-inflicted delay, which means you may face additional costs.

In the case of hourly bookings, surcharges for additional kilometres (exceeding the conventional kilometres already included per hour and business district) are charged. We work out the additional kilometre price using the distance based prices of the booked vehicle category and business district, plus applicable VAT.

You have the option to pay for your trip by credit card. The resulting card fees are paid by P&P Shuttle. Any transaction fees for bank transfer payments (e.g. due to different currencies or different local bank accounts) would be borne by you, the customer.

We reserve the right to charge 5 Euros for each payment reminder we have to issue as a result of a late payment.

For non-redeemable credit card entries, we reserve the right to charge you for accrued expenses such as charges from bank or credit card companies, and to charge an administrative fee of 8 Euros per incident.

We will transmit your invoice electronically via email or web download into your customer account.

5. Cancellation and rebooking

In the case of transfer ride, if the driver has not yet set off for the pick-up location and/or there is more than one hour until the pick-up time, you can cancel or rebook with P&P Shuttle free of charge. However, if the driver has already left to meet you or there is less than one hour until the booked pick-up time, we will charge the cost of the total fare for cancellation or rebooking.

In the case of hourly bookings, you can cancel or rebook with P&P Shuttle free of charge if more than 24 hours remain until the agreed pick-up time. If there is less than 24 hours until your pick up but your driver has not set off for the pick-up location, we will charge 50% of the agreed fare for cancellations or rebooking. If your chauffeur has already left for the pick-up location or less than one hour remains until the pick-up time, the total fare will be charged for a cancellation or rebooking.

If P&P Shuttle has to cancel your pick-up for any reason, already paid fares will be refunded. A claim for compensation or additional claims are excluded.

We classify rebookings as new bookings, in that they are again treated as a binding booking request.

If you do not show up for your pick-up and have not notified us in advance, your booking will be charged at 100%. A no-show is classed as anyone who does not appear at the agreed pick-up location within 30 minutes after the agreed pick-up time (unless it is a pick-up from an airport or train station). At airports or train stations, your driver will wait up for to 60 minutes for you. This time starts from the scheduled pick-up time. If you have spoken to the driver by phone and rearranged a new pick-up time, this rule does not apply. You can contact us to request that your chauffeur waits for you but this waiting time will be charged per minute according to the rates set for the business district and the vehicle category.

6. Your behaviour in the vehicle

As we offer international transfers, the regulations of the relevant national Road Traffic Acts apply during your entire ride, particularly the general requirement that you wear a seat belt.

The driver has a responsibility to perform the ride safely and to be attentive to the welfare of all passengers. You can help the chauffeur by following their instructions at all times.

You are prohibited from opening the doors when the vehicle is in motion, to throw objects from the vehicle and/or to stick out body parts or to scream or shout out of the vehicle.

Smoking is prohibited in the passenger compartment of any P&P Shuttle vehicles. We reserve the right to charge for any cleaning costs or repairs that result from infringement of this condition. We would prefer that you do not bring food into the vehicle. Bringing along and consuming alcoholic beverages is allowed only upon prior arrangement with P&P Shuttle. Should a vehicle require valeting due to negligence or alcohol illness, a charge will be made to cover the cost of cleaning and subsequent loss of earnings.

7. Liability and warranty

P&P Shuttle cannot be held responsible for any loss – financial, personal or professional – or missed connection times, flights or trains due to the vehicle not arriving at the pick-up address at the booked time.

Similarly, we cannot be held responsible for any missed connections due to adverse weather, traffic conditions, road traffic accidents or road closures.

A liability for the services provided by any associate transport companies and their drivers is excluded. However, where we do need to engage the services of another transport company (to be able to provide you with a suitable vehicle or during particularly busy times of the year), we shall be held liable for the careful selection and monitoring of these service providers only. The amount of liability is limited to twice the fare of the ride.

If you do have any concerns at all about your vehicle and/or driver or your experience as a customer, please notify P&P Shuttle without delay.

Although vehicles are fully insured, users carry their property entirely at their own risk and P&P Shuttle is not liable for theft, loss or damage to property carried in the vehicle.

Compensation claims by you, the user, expire at the end of three months after the termination of the contract. If you demand compensation for damages on account of non-fulfilment, you have one month to claim. After the deadline, you may only assert claims if you have been prevented (through no fault of your own) from meeting the deadline. All claims for damages are limited to one year after their formation. This does not apply to claims deriving from impermissible acts.

We reserve the right to discontinue our service permanently or temporarily on important grounds without inducing a liability.

P&P Shuttle is liable, regardless of the legal grounds, only for intent and gross negligence, unless it is the breach of a contractual obligation. For loss of profits, loss of savings, incidental damages and/or consequential damages, P&P Shuttle is only liable for wilful infringement. Except for wilful infringement, P&P Shuttle’s liability shall be limited to damages which were reasonably foreseeable at the conclusion of this contract. From the foregoing limitations of liability, the liability remains unaffected for culpable injury to life, limb or health.

8. Obligations of the user

You are responsible for the information that you provide to P&P Shuttle, either for yourself or on behalf of another person, and must ensure that it is accurate. Registration using a false, fraudulent, speculative or similar process is prohibited.

In using the transportation services of P&P Shuttle, you are confirming that they will only be used for legal transactions.

The user indemnifies P&P Shuttle from all claims and expenses, including legal fees, which result from the unlawful use of our services, or breach of these terms and conditions.

The above terms and conditions apply to any employees, legal representatives or agents of P&P Shuttle, where claims are asserted directly against them.

The user is liable for all damages caused by him to the vehicle and/or driver.
